What can a court actually do with ChatGPT conversations?

A court can order a company to keep data it would otherwise delete, and that is what happened in one well-known New York case. This page walks through that case so you can see a real example instead of a rumor.

It does not tell you whether your own chats could be demanded in any other case. That depends on the case, the court and the plan you use, and it is a question for your own lawyer.

What did the court order in May 2025?

In May 2025, a federal court in New York ordered OpenAI to preserve and set aside ChatGPT output log data that would otherwise have been deleted. The order of May 13, 2025, came from Magistrate Judge Ona T. Wang in the New York Times copyright case.

According to OpenAI's own account, the order reached ChatGPT Free, Plus, Pro and Team, and the API, except API use under zero data retention. Enterprise was excluded.

What ended, and what is still preserved?

As of November 2026, the duty to keep new data going forward has ended, but data already set aside is still preserved. A stipulation and order of October 9, 2025, ended the going-forward duty as of September 26, 2025.

Logs set aside before that date stay preserved. There is an exception for requests from the EEA, Switzerland and the UK. Data for accounts tied to the news plaintiffs' domains is also still preserved.

Orders like this change, so check a current source before you rely on any of it.

What happened to the chat logs in that case after that?

On January 5, 2026, a federal judge ordered production of 20 million de-identified chat logs in that case, as reported by the ABA Journal. De-identified means personal details were removed from the logs.

This page does not say how the order was carried out or what any party now holds. It only shows that a court was willing to order logs of this size to be produced in that case.

Are your chats with an AI covered by legal privilege?

OpenAI's CEO has said they are not. In July 2025, on a podcast reported by TechCrunch, he said conversations with ChatGPT do not carry the legal privilege that applies when you talk to a lawyer, doctor or therapist.

He had called for an "AI privilege" to exist in June 2025. That was a call for a new kind of protection. Ask your own counsel how privilege applies to your situation.

What changes when your conversations live in an account you own?

Fewer companies hold your conversations. With a private AI setup in a cloud account you own, Freeborn Labs does not hold your files, so your chats are not sitting with us or with a shared chat app.

That does not put your own records beyond legal process, and it does not create privilege. Records you keep are still yours to manage, and a court can still direct you to keep or produce them. See how running AI without ChatGPT seeing your data works, or compare private ChatGPT alternatives.

What should you do day to day?

Decide what goes into any AI tool before you type it, and decide how long you keep it. Your counsel can tell you what to keep and for how long, especially if a dispute is possible.

If you would rather build it yourself, the DIY guides cover access limits and backups. The same rules apply to your own server: strong passwords, limited logins, backups and a plan for deleting old history. A note on chat history on your own server covers that last part.

What are the limits?

A private setup lowers the number of parties holding your data, and that is all it does. It does not make your records exempt from legal process, create privilege, or replace your own judgment.

This is general information, not legal, medical, financial or tax advice. Ask your own counsel, compliance officer or adviser what applies to you. Freeborn Labs promises no outcomes. More questions are answered in the private AI answers hub.

Questions

Did the court hand all ChatGPT chats to the New York Times?

No. The May 2025 order required OpenAI to preserve certain output log data, and a January 2026 order covered production of 20 million de-identified chat logs in that case.

Does the preservation order still apply?

The going-forward duty ended as of September 26, 2025, under the October 9, 2025 stipulation and order. Logs already set aside before then stay preserved, so check a current source for the latest status.

Were business plans covered by the order?

According to OpenAI's account, Enterprise was excluded, while Free, Plus, Pro, Team and the API without zero data retention were reached. Plan names and terms change, so read the terms of your exact plan.

Is a private AI setup beyond the reach of a court?

No. Records in your own account can still be subject to legal process, and a setup creates no privilege. It means fewer companies hold your conversations.

Should I delete my chats?

Ask your own counsel first. Deleting data when a dispute is possible can create its own problems, so decide what to keep and for how long before you act.
